These Terms and Conditions regulate the use of the Online Payment facility provided by Beyond Borders Tours N Travels.
1. Definitions
1.1 “Foreign Agent” means any tour operator, travel agency, or individual who desires to pay for ground handling services booked offline as per the terms and conditions of the Proforma Invoice, contract, or email correspondence with Beyond Borders Tours N Travels, using the online payment facility over the Payment Gateway.
1.2 “Merchant” means any person who owns, manages, or operates the Merchant Establishment through a physical location and/or the website www.beyondborderstoursntravels.com.
1.3 “Facility” means the provision of online payment services to the Foreign Agent, subject to the terms and conditions set forth herein. The Facility is provided with reasonable care and skill.
1.4 “Service Hours” refers to 24 hours a day availability.
2. Contractual Relationship
These Terms and Conditions form an integral part of the contract between the Foreign Agent and Beyond Borders Tours N Travels.
3. Payment Gateway Validation
The Payment Gateway provider shall validate the credit card details furnished by the Foreign Agent during transactions.
4. Facility Discretion and Modification
The Facility is provided at the sole discretion of Beyond Borders Tours N Travels, which reserves the right to add, revise, suspend, or discontinue all or part of the Facility without prior notice. Such changes shall be binding on the Foreign Agent. Use of the Facility constitutes acceptance of these Terms and Conditions.
5. Payment Authorization and Liability
The Foreign Agent acknowledges that, while making payment through the online Payment Gateway, no physical charge slips will be signed. In case of any dispute concerning the authenticity or validity of the payment, the Foreign Agent remains liable to pay any outstanding amount for services booked or utilized.
6. No Obligation to Verify Payment Authenticity
Beyond Borders Tours N Travels is not obligated to verify the authenticity of payments made by the Foreign Agent through the Facility.
7. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by Indian law. All disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts and tribunals in New Delhi, India.
8. Severability
If any term or condition herein is declared invalid, illegal, or unenforceable by a competent court, such invalidity shall not affect the remaining provisions, which will continue to be valid and enforceable.
9. Privacy Policy
9.1 Beyond Borders Tours N Travels may collect confidential information about the Foreign Agent during the use of this Website and online transactions. We are committed to protecting this information and ensuring its confidentiality.
9.2 We will not disclose any personal information except when required by law, to enforce these Terms, protect our rights, or protect the interests of the Foreign Agent.
9.3 The Foreign Agent authorizes us to share transaction details and information with affiliates, banks, financial institutions, credit bureaus, or agencies as required by law or customary practice. Beyond Borders Tours N Travels shall not be liable for such disclosures.
10. Amendments
Beyond Borders Tours N Travels reserves the right to amend, revise, suspend, or cancel the online payment Facility or these Terms at any time. Updates will be notified on the website, and continued use of the Facility implies acceptance of such changes.
11. No Waiver
Failure or delay in enforcing any right under these Terms shall not be construed as a waiver of such right or any other rights.
12. Disclaimer
The Foreign Agent agrees that Beyond Borders Tours N Travels will not be held responsible for any incorrect or incomplete details furnished during online payment transactions.
13. Rights Reserved
All rights not expressly granted to the Foreign Agent are reserved by Beyond Borders Tours N Travels.
14. Charges
A processing fee will be charged on online payments as follows:
- 2.2% for MasterCard and Visa cards
- 3.6% for American Express cards
These fees are calculated on the total amount transacted via the payment gateway.
15. Cancellation Policy
Any cancellation of services paid via the online payment gateway is subject to the cancellation terms agreed upon with the Merchant.
16. Refund Policy
Payments made via the online payment gateway are non-refundable. Any unadjusted amount may be credited as advance for future services availed by the Foreign Agent or their clients.
17. Liability
Beyond Borders Tours N Travels shall not be liable for any loss or damage arising from declined authorization of any transaction due to reasons such as exceeding preset credit limits agreed with the acquiring bank.
